Biases bear the potential of derailing mediation processes and can spoil their success altogether. Recognizing and eliminating these biases, especially when they occur in a cross-border context, is therefore paramount. The 3rd Biennial Mediation Symposium hosted by the Center for International Legal Studies (CILS) covered a diverse range of mediation topics. One panel was exclusively dedicated to the issue of cultural considerations in mediation. Together with other leading ADR practitioners, Vavrovsky Heine Marth partner Anne-Karin Grill addressed how cultural dimensions are increasingly relevant to dispute resolution and set out how they can be built into the process already at a very early stage, i.e. during case analysis and strategic planning. Rejecting the notion of "one size fits all", the process must be designed to fit the cultural common sense of the parties. This will result in higher levels of commitment and procedural satisfaction. In a world where cultural evolution is driven by technological and financial integration, dealing with people and their disputes is not a linear process. The legal profession must adapt and incorporate cultural considerations in the facilitation of disputes.
